Lemon Laws
Kentucky’s lemon laws allow you to collect a refund for your automobile, or upgrade to a new one, if you can prove that the problems you are experiencing with your new automobile began within the first 12 months or 12,000 miles (the earlier of the two) of your ownership, and one of the following: that you took the vehicle in for warranty repairs 4 or more times for the same condition; that it was out of service for 30 days due to the same condition; and that the defect affected the safety or value of the vehicle and the seller has been unable to correct the problems.

It is important to note that the defect must be the fault of the manufacturer and not due to alteration, neglect or abuse. In certain circumstances, Kentucky and federal law permit a successful claimant to recover attorney's fees in addition to the damage award.

In some cases, a claimant can be successful even if the above requirements are not met. If you are considering a lemon law case, you will need to consult with an attorney familiar with the laws concerning such a case. An initial consultation is important in order for you to learn, among other things, what documents you need in order to proceed and how to gather them, as well as how to document your claim.

Manufacturers often do not want to refund your money or replace your vehicle. They want to attempt repairs to your vehicle at the least possible expense to them. Therefore, should you choose not to employ an attorney, your chances of recovering a full refund are small and you will often waste valuable time dealing with the manufacturer’s stall tactics. This, among other reasons, is why you need an attorney who is knowledgeable and prepared to deal with them.

Our goal, when filing a lemon law complaint, is to secure a settlement for you as quickly as possible, whether through a cash award or a new vehicle. If you feel you have purchased a “lemon” automobile, please contact us for a consultation with an experienced lemon law attorney.
